By downloading, accessing, or using the app or website, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the Service.

You are not allowed to copy, modify, distribute, or create derivative works based on the app, any part of the app, or our trademarks in any way. You are not allowed to attempt to extract the source code of the app, reverse engineer, or translate the app into other languages. The app itself, and all trademarks, copyright, database rights, and other intellectual property rights related to it, remain the property of iMuskoka or its licensors.

iMuskoka is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to introduce paid features or services at any time and for any reason. Any applicable fees will be clearly disclosed to you before you incur them.

The iMuskoka app stores and processes personal data that you have provided to us in order to provide our Service. It is your responsibility to keep your device and access to the app secure.

Accounts and Authentication

The Service may allow you to create an account or sign in using third-party authentication providers such as Apple, Facebook, Google, or LinkedIn. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are used in a manner that may harm the Service, other users, or third parties.

Acceptable Use

You agree not to misuse the Service or assist anyone else in doing so. This includes, but is not limited to:

• Attempting to extract source code or reverse engineer the application;
• Using automated systems such as bots, scrapers, or data mining tools;
• Interfering with the security or integrity of the Service;
• Using the Service for unlawful, fraudulent, or harmful purposes.

You should be aware that certain functions of the app require an active internet connection. iMuskoka cannot take responsibility for the app not working at full functionality if you do not have access to connectivity.

If you are using the Service outside of an area with Wi-Fi, your mobile network provider’s terms will still apply, and you may incur data charges. You accept responsibility for any such charges.

iMuskoka cannot be held responsible for issues arising from device misuse, including but not limited to jailbreaking, rooting, or running unsupported configurations.

While we strive to ensure the information provided through the Service is accurate and up to date, we rely on third-party data providers and cannot guarantee completeness or accuracy. iMuskoka accepts no liability for any loss, direct or indirect, resulting from reliance on such information.

MLS® Listings and Virtual Office Website (VOW) Services

Certain features of the Service may provide access to MLS® listing data and Virtual Office Website (“VOW”) services operated in compliance with applicable real estate regulations and PropTx rules.

Access to MLS® data and VOW features is subject to additional Terms of Use, which you will be required to review and accept through a click-through agreement before accessing such features.

These additional terms govern your use of listing information, including restrictions on use, intellectual property rights, and your relationship with the applicable brokerage.

Limitation of Liability

To the fullest extent permitted by law, iMuskoka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

At any time, we may update, modify, suspend, or discontinue the Service (or any part of it) without notice. We may also terminate your access if you violate these Terms.

Upon termination, your rights to use the Service will cease immediately, and you must discontinue use of the app and delete it if applicable.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
